Historical background

India and Morocco have historical ties going back to the 14th Century when Ibn Batuta travelled to India. His writings on medieval Indian society are as much an important source of historical information about India to the Indians as to the Moroccans. In modern history, India was active in the UN supporting the Moroccan freedom movement and recognised Morocco on 20 June, 1956 when it became independent of the protectorate arrangements with France. Diplomatic Missions were established in 1957.

The functions of the Embassy may be summarized as:

1.Representing India;
2.Protecting India’s national interests in Morocco;
3.Promoting friendly relations with the State as also its people;
4. Reporting accurately on developments in the country which are likely to influence the formulation of India’s policies;
5. Negotiating agreements on various issues with the authorities of the receiving state;
6. Extending consular facilities to foreigners and Indian nationals abroad.

Allocation of business to the Embassy of India in Rabat

The elements of work allocated to the Embassy of India in Rabat by the Ministry of External Affairs including those concerning India’s diplomatic relationship with Morocco from the overall elements of work of the Ministry of External Affairs under the Transaction of Official Business Rules of the Government of India, as amended from time to time. Article 4(1)(b)(ii) of the Right to Information Act, 2005: Powers and duties of the employees of the Embassy of India in Rabat:

Financial powers of the employees of the Ministry of External Affairs, and consequently the officials of the Embassy, have been detailed in the Delegated Financial Powers of the Government of India Representatives Abroad. Other powers of some of the designated officials of the Embassy of India in Rabat are derived from the Passport Act. This Act is on the MEA website. The specific duties of the passport/consular officers towards the public have also been outlined on the MEA website (www.mea.gov.in).

General Administrative powers are derived from :

  • Fundamental Rules & Supplementary Rules.
  • Indian Foreign Service (PLCA) Rules, as amended from time to time.
  • Financial powers of the Officers of the High Commission of India have been detailed in the Delegated Financial Powers of the Government of India’s Representatives Abroad.

  • Visa Manual
  • Ministry of External Affairs guidelines issued from time to time on Passport and Consular matters.

  • Other powers are derived from (i) various guidelines &instructions issued from Ministry of External Affairs, Home Affairs and Commerce & Industry; (ii) other Ministries/Departments of Government of India in consultation with MEA.

Article 4(1)(b)(iii) of the Right to Information Act, 2005: Procedures followed in the decision making process, including channels of supervision and authority:

Decisions are taken under the instructions and supervision of the Ambassador.
The Embassy of India in Rabat follows the Procedure indicated in the Manual of Office Procedure of the Ministry of External Affairs for decision-making.

Article 4(1)(b)(iv) of the Right to Information Act, 2005: Norms set by the Ministry for the discharge of its functions

The norms established for passport services have been outlined on the MEA website. The response to information sought under Right to Information will be given as per the time stipulation prescribed in the Act.

Payment of RTI fee online - Electronic Indian Postal Order (eIPO)

The scheme of Electronic Indian Postal Order (eIPO) has been launched by the Department of Posts, Ministry of Communications and Information Technology, in association with Department of Personnel and Training (DoPT). This would enable the Indian citizens abroad to pay the RTI fee online.
An Indian Postal Order can be purchased electronically by paying a fee on-line through e-Post Office Portal or through India Post website. The web-links for payment are:

The Credit Card or Debit Card of any bank powered by Visa/ Master can be used for this purpose.

Procedure

The RTI applicant is required to register on the website to create his/ her profile. Then he has to select the Ministry/ Department from whom he desires to seek information under the RTI Act. The eIPO is generated which can be used to seek information from that Ministry/ Department only. A printout of the eIPO is required to be attached with the RTI application sent in hard copy. In case RTI application is filed electronically, the eIPO is enclosed as an attachment. The profile is required to be created during the first time only.

The RTI application accompanied by an eIPO is similar in all respects to the RTI application accompanied by fees through any other approved mode. All the provisions regarding eligibility, time limit, exemptions etc; as provided in the RTI Act, 2005 continue to apply.

Currently, this facility is available only for Indian Citizens living anywhere other than in India. By this measure, those living abroad would be facilitated to seek information under the RTI Act, 2005. It is hoped that in future, this facility would be extended to all citizens within the country too. Any public authority which accepts a postal order should also accept an eIPO.
